Theft & Robbery
Theft, snatch theft, robbery and gang-robbery charges under the Penal Code carry custodial sentences and, in aggravated cases, mandatory whipping. Identification evidence, CCTV interpretation and recovery of property are often the heart of the dispute.
How I approach it
We test identification parades, examine CCTV continuity, challenge confessional statements taken without caution, and probe whether 'recovery' of items truly links the accused to the offence under s.27 of the Evidence Act.

What is at stake
Theft
Up to 7 years' imprisonment and a fine; longer terms where committed in a dwelling or by a servant.
Robbery
Imprisonment of up to 14 years and mandatory whipping under s.392.
Gang-robbery
Minimum 5 years and up to 20 years' imprisonment with whipping under s.395.
Defences I build
Mistaken identification
Eyewitness identification is notoriously unreliable. Defective ID parades and poor CCTV resolution open serious doubts.
No dishonest intention
Theft requires proof of dishonest intention at the time of taking — disputes over ownership or claim of right can defeat the charge.
Exculpatory statements wrongly excluded
We ensure the accused's own version, where consistent and exculpatory, is properly placed before the court.

Robbery requires force, or threat of force, used in committing or attempting theft. The presence of a weapon further aggravates the offence.
Yes — s.392 makes whipping mandatory on conviction for robbery. That is precisely why these charges must be defended seriously from the start.
Possession alone is not conclusive. The prosecution must prove knowledge, and s.27 'discovery' evidence is open to challenge.
