Domestic Violence Defence
Allegations under the Domestic Violence Act 1994 — read with the Penal Code — are often raised against the backdrop of marital breakdown, custody disputes or financial conflict. The consequences include criminal liability, Interim Protection Orders, and serious immigration and employment fallout.
How I approach it

Defences I build
False or exaggerated allegation
Allegations made in the heat of a separation or custody dispute can be tested against contemporaneous messages, medical records and witnesses.
Self-defence
Where the accused was in fact protecting themselves or a child, the right of private defence is a complete answer.
Lack of corroboration
Hospital records, CCTV and digital evidence often tell a different story to that put forward by the complainant.
Common questions about Domestic Violence Defence
An IPO is a court order made under the DVA 1994 restricting the accused's contact with the complainant during investigation. Breach is a separate criminal offence.
Yes — criminal allegations can be used in family proceedings. Our defence is always coordinated with your family lawyer to protect both fronts.
They can decline to testify, but the DPP can still proceed using independent evidence. Strategy is critical from day one.
