Pre-Trial & Custody
Bail Applications & Release
The hours after an arrest are the most important in any criminal case. A well-prepared bail application can mean the difference between sleeping at home and weeks in remand while the investigation runs its course.
How I approach it
We attend the police station, lock-up or remand court at short notice, prepare bail bonds, identify sureties, and present a structured application that addresses flight risk, interference with witnesses, and the seriousness of the alleged offence.
Speak to RohanCharges I represent
- Bailable offences under the First Schedule of the Criminal Procedure Code
- Non-bailable but bailable-by-discretion offences
- Remand applications under s.117 CPC
- Variation, reduction and revocation of bail
What is at stake
Remand
Up to 14 days of investigative detention if bail is denied or remand is granted under s.117 CPC.
Forfeiture
Sureties may be called upon to forfeit the bail sum where conditions are breached.
Re-arrest
Breach of bail conditions can trigger re-arrest and stricter conditions on any future release.
Defences I build
Strong community ties
Evidence of stable employment, family responsibility and a permanent address goes directly to the question of flight risk.
No risk of interference
Where witnesses are independent or already on record, the court is more willing to release the accused on bail.
Health & humanitarian factors
Serious medical conditions, caregiving responsibilities and the principle of presumption of innocence often justify release on conditions.
Common questions about Bail Applications & Release
We respond on the same day. Early intervention during remand applications often determines whether bail is granted at all.
Bailable offences attract bail as of right. Non-bailable offences are still bailable in many cases — but only at the court's discretion, which is where representation matters most.
Usually a Malaysian citizen, of sound financial standing, able to deposit the bail amount and undertake responsibility for the accused's attendance in court.
